What is changing

The amendment gives residents, housing communities and housing cooperatives, as well as municipalities, more tools to deal with short-term rentals. According to the ministry, the aim is to protect peace, safety and public order, while giving businesses time to adjust.

Key solutions

  • Ban in a building: a housing community or cooperative will be able to adopt a resolution banning short-term rentals in a property. In a cooperative, a majority of more than 50% of those entitled to vote will be required. After a ban is adopted, the business will have 6 months to end its activity in the building.
  • Inspections: housing communities, cooperatives and people living in the same or a neighboring property will be able to request an inspection of a facility, including with regard to safety and public order.
  • Removal from the register: if, within 6 months, services or authorities find 3 violations concerning safety or public order, the local government will be required to remove the facility from the register of places providing hotel services.
  • Zones in municipalities: a municipal council, at the request of the wójt, mayor (burmistrz) or city president, will be able to designate zones in which rentals are restricted or banned. A ban may apply to specific areas, facilities or periods, e.g. only selected days of the year.

When

Most of the provisions are to enter into force 14 days after the act is published in the Journal of Laws (Dziennik Ustaw). Bans in housing communities and cooperatives, as well as municipal zones, will take effect on January 1, 2028.

What to do

  • Follow the Senate's work, as the text may still change.
  • Companies offering short-term rentals should put safety and order in their facilities in good shape, because violations may result in removal from the register.
  • Check whether your facilities are located in buildings or areas where bans are possible.
