Training

Training on the "Lex Kamilek" Act.

The Act on Counteracting Threats of Sexual Crime and on the Protection of Minors.

Since 15 February, amendments to the Family and Guardianship Code (Kodeks rodzinny i opiekuńczy) have been in force, also known as Kamilek's Law, which introduces an obligation to have "Minor Protection Standards" for entities that work with children. The new regulations place this responsibility on educational institutions (such as preschools, schools and youth hostels), care, educational, recreational and sports facilities, and others that have contact with minors. This also applies to organisers of educational, religious, artistic and medical activities, as well as hotel and tourism services, and collective accommodation facilities.

The obligation to introduce the standards must be fulfilled within 6 months of the entry into force of the Act, that is, by 15 August 2024.

The introduction of child protection standards by entities working with children should include:

  1. vetting of staff with regard to child safety;
  2. developing rules for a safe staff-child relationship (a child protection procedure, a procedure to follow when a child is harmed, a list of telephone numbers of local child protection organisations, and clear, easy-to-understand instructions for children);
  3. developing intervention pathways for cases of suspected harm to children;
  4. training staff in child protection.

Knowledge of the standards applies to every employee and co-worker (employment contracts, civil-law contracts, B2B contracts).

Who is affected:

  • entities providing hotel services,
  • tourism entities (holiday resorts, coach tours),
  • entities operating other collective accommodation facilities,
  • education organisations (preschools, schools and youth hostels),
  • sports clubs and community centres,

directly (teachers, canteen staff, coach drivers, parents travelling on a trip with children) or

indirectly (cleaning staff, cooks).

Training sessions are held regularly; current dates are published on our Facebook page and in our group: https://www.facebook.com/TurystycznaOrganizacjaOtwarta.

Training programme:

1) Who is covered by the Act

2) What the minimum requirements for compliance are (necessary documentation)

3) Detailed discussion of care organisers, travel companies and carriers

4) Penalties for lacking standards, supervisory bodies (fines, reprimands, a "blacklist" in local governments)

5) How to prepare for inspections by the National Labour Inspectorate (PIP), the municipal head (wójt) and the voivode.

The training ends with a certificate for each participant.

Training cost:

  • a person representing a business that is a member of the association (price per person): PLN 100
  • association supporter: PLN 200

If, within 14 days of the training, you decide that it is worth implementing the full documentation in your company:

  • Association member: PLN 250
  • Supporter: PLN 400

Requesting the documentation within 14 days of the training means that part of the training cost for the person representing the company will be deducted from the price of the full documentation (PLN 50 for association members and PLN 50 for others).

Applying after the 14-day period following the training means the full price for preparing the documentation will be charged: PLN 500.

A training tailored to a company, together with the preparation of documentation, costs at least PLN 600; the final price depends on the number of participants and the size of the company.

The workshop will be led by Małgorzata Machaj.
